Main areas of responsibility of Waste Enforcement Section
The Waste Enforcement Section of Fingal County Council has responsibility for enforcement of the following environmental regulations:
• Waste Management Act 1996
• Waste Management (Packaging) Regulations 2007 as amended.
• Waste Management (Collection Permit) Regulations 2007
• Waste Management (Facility Permit and Registration) Regulations 2007
• Waste Management (Environmental Levy) (Plastic Bag) Regulations 2001
• Waste Management (Movement of Hazardous Waste) Regulations 1998
• Waste Management (Waste Electrical & Electronic Equipment) Regulations 2005
• Waste Management (End-of-Life-Vehicles) Regulations 2006
• Waste Management (Batteries and Accumulators) Regulations 2008
• Waste Management (Tyres and Waste Tyres) Regulations 2007
• Waste Management (Food Waste) Regulations 2009
• Waste Management (Prohibition of Waste Disposal by Burning) Regulations 2009
The section also has responsibility for the management of the Environmental complaints system and the investigation of complaints which can lead to the initiation of legal action under the Waste Management Acts 1996.
The section ensures producer responsibility and compliance under the various regulations above.
The enforcement role in the department is carried out by authorised officers, appointed and conferred with powers under the Waste Management Acts 1996.
Ultimately, the Enforcement Section’s goal is to ensure compliance with the law.
Companies and individuals must comply with the law and enforcement action is only taken where necessary.
