Battery Regulations: implications for retailers
New Regulations have been passed on the 16th July 2008 to promote the recovery of Batteries and Accumulators. These can be downloaded for the Department of Environment, Heritage and Local Government web site.
The Regulations impose obligations on persons who supply Batteries and Accumulators to the Irish Market.
This Section of the website gives details as to what obligations are imposed on retailers.
From the 26th September 2008, Retailers:
- - must now take back waste batteries free of charge of the type that they sell – for instance, if you sell portable batteries such as types AAA, AA, Cell C, Cell D, PP3 etc. you will not be obliged to take back automotive, industrial or small sealed lead acid batteries for alarms.
- - of automotive and industrial batteries must register with their local authority.
- - may deposit waste portable batteries free of charge at local authority civic amenity facilities.
Retailers who wish to receive a collection box should contact the compliance scheme European Recycling Platform at 01-2995642 to arrange delivery of the appropriate battery container.

Which Retailers should register?
If you are a retailer selling Electrical and Electronic Equipment and are already registered with Fingal County Council or European Recycling Platform under the WEEE Regulations you are deemed registered for the Battery Regulations.
If you are not selling Electrical and Electronic Equipment, and only selling portable batteries (such as types AAA, AA, Cell C, Cell D, PP3 etc.), you are exempt from registering (but must still accept waste batteries free of charge).
If you are not selling Electrical and Electronic Equipment, but are selling industrial or automotive batteries, you must register with Fingal County Council or European Recycling Platform by completing the application form below. A registration fee of €20 per premises may apply.
