I am a Tenant of Fingal County Council, can I apply to buy my home?
If you hold a tenancy of at least one year with Fingal County Council you may be eligible to buy your home under the Tenant Purchase Scheme. Applicants must be named on the Tenancy Agreement.
If your name is not on the Tenancy Agreement you may apply to have your name included if you have been a bona fide resident in the house for at least two years continuously and have been assessed for rent at the dwelling.
Your rent must be paid on time and in full to the Council at all times and there must not be anti-social behaviour associated with the dwelling.

I purchased my house from the Council under the Tenant Purchase Scheme and I want to sell my house, what do I need to do?
If you want to sell your house, you must apply to Fingal County Council for the Council's consent to the Resale and the intended purchaser must also complete an application form.
Why is the Council's consent required?
The Council's consent is required because there are special conditions attached to every house sold under the Tenant Purchase Scheme. The conditions are attached to such a house by the Council to ensure that when it is sold that it will not leave the vendors or their dependents without adequate housing. A vendor must be providing housing for themselves elsewhere. Information in relation to the vendor's intended new home will be required.
The purchaser must complete an application form so that the Council can ensure that the intended purchaser is a person in need of housing and that the house which was formerly owned by the Council will continue to be a permanent place of residence and will not be bought for investment purposes. The purchaser must be in need of housing and must not own another house (if they do, they must be selling it or have contracted to sell and it will be a condition of the re-sale that proof of the sale be provided).

If you want to Re-Mortgage your house, you must apply to Fingal County Council for Consent to Re-Mortgage.

The Council's consent is required because there are special conditions attached to every house sold under the Tenant Purchase Scheme. The consent of the Council must be sought to Re-Mortgage under the following circumstances; in the case of a house purchased before 1995, for a period of 25 years from the date of purchase and in the case of a house purchased after 1995, for a period of 20 years from the date of purchase.
How do I apply?
There is no application form for consent to Re-M ortgage. To apply, your Solicitor may make an application in writing on your behalf and the following details are required in the letter:
1. The name of the Financial Institution
2. The amount of the Re-Mortgage
3. The purpose of the Re-Mortgage.

I want to Transfer the Ownership of the house I purchased under the Tenant Purchase Scheme. What do I need to do?
If you want to transfer ownership of the property, the consent of the Council must be sought.
Why is the consent of the Council required?
The Council's consent is required because there are special conditions attached to every house sold under the Tenant Purchase Scheme. The consent of the Council is required under the following circumstances; in the case of houses purchased before 1995, for a period of 25 years from the date of purchase and in the case of houses purchased after 1995, for a period of 20 years. The following transfers may be sought:
- from sole to joint names (e.g. in the case of marriage)
- from joint to sole name (e.g. legal separation or divorce) N.B Consent is not necessary in the case of death. In this case the Death Certificate should be lodged with the Property Registration Authority and a copy of the updated Folio for the property should be sent to the Council to amend records.
- into name(s) of successor(s) in title (e.g. Tenant Purchaser is deceased)
- Transfer of Ownership and Re-Mortgage.
