This section is responsible for:

  • Monitoring developments to ensure that the Building Regulations are complied with.
  • Monitoring extensions and renovations to ensure that the Building Regulations are complied with.
  • Enforcing compliance where non-compliance of regulations has been determined
  • Carrying out of inspections of dwellings in connection with Disabled Persons Grants (DPG) on behalf of the
  • Housing Department.
  • Processing Taking In Charge (TIC) requests.
  • Dealing with the completion of outstanding works in new estates and developments to enable roads, footpaths, margins, watermains and sewers in new estates and developments to be taken in charge.

Taking In Charge (TIC)

1. Fingal County Council requires the taking in charge all services and areas used in common in residential developments with the exception of;

(a) Structures of buildings within which more than one dwelling is accommodated, the common areas in the immediate vicinity of these buildings giving access to common facilities for these buildings such as storage areas, refuse storage areas, boiler and plant rooms, private or incidental landscaped areas or open space, designated car-parking or car parking  structures; and
(b) The totality of the development, including roads, services, landscaped areas, boundaries etc. in the case of developments that are exclusively “Gated Communities”.

 

2. Taking in charge means the provision of the following services by the council:

  • Maintenance of all roads and footpaths completed in any materials, including communal street car parking.
  • Repair and reinstatement of roads, footpaths completed in any materials, and landscaped areas resulting from repair and/or maintenance of underground services provided by the council (watermains and drainage services);
  • Road sweeping and cleaning the principal routes within the housing developments;
  • Maintenance, including grass cutting and upkeep, of all the principal landscaped areas in housing areas – but excluding grass verges and minor incidental areas that may be planted or seeded;
  • Upkeep and maintenance of all elements of surfaces, fixed elements and rigid play equipment in playlots or playgrounds, or other monuments or structures where provided in class 2 open spaces, and following a specific arrangement in communal open space; and
  • Upkeep and maintenance of all public lighting installations including non-standard light fittings.

 

3. The extent of the area that will be taken in charge by the Council will be determined in accordance with the 2008 taking in charge policy in discussions prior to the receipt of planning applications and will be delineated clearly on a site layout drawing, complete with accompanying descriptions, which will form part of the Planning Application documentation.

 

4. The Council shall take in charge boundary, walls, fences and pillars where they form the boundary between two areas that are in charge of the Council.

 

5. The Council requires that, to the greatest extent possible, there is clear, discernible and practical delineation between areas that will be taken in charge and those that will remain the responsibility of householders or combinations of householders who may assemble in their common interest.
