Sale of Council Property
Land or properties that are not required for community, recreational, residential or commercial use by the Council are sold out of Council ownership.
Anyone wishing to buy Council land or property must submit a request in writing along with a map that clearly indicates the area required. The intended future use of the property should also be explained.
Once applications are acknowledged in writing the Council checks their ownership of the property and circulates the request to other Departments within the Council to make sure the property can be sold. Sometimes properties cannot be sold because they have public services on them or because of their zoning, development control restrictions or traffic restrictions. An applicant will be notified in writing if the Council cannot sell the land or property to them.
If a property can be sold, accurate maps are prepared and details of the application are forwarded to the Council’s Valuer to estimate a value for the land or property being sold. Council land or property is formally offered for sale in writing only and offers must also be formally accepted in writing.
Any proposal to sell Council land or property must be approved by the elected Councillors of Fingal County Council, under Section 183 of the Local Government Act, 2001, at a monthly meeting of the full elected Council. If the sale is approved by the Councillors, the County Solicitor is instructed to transfer title liaising with the applicant’s solicitor.
Applications to acquire laneways or parts of laneways are only considered by the Council in the following circumstances:
- If the public right of way has been extinguished,
- If the laneway is free from public services,
- If all residents with access onto the laneway agree to incorporate the laneway into the adjoining properties.
